How to be prepared for your Notary appointment

  • Prepare Documents: Gather all documents needing notarization. Ensure they're completed except for signatures, which will be done in front of the notary.
  • Review: Take time to understand the documents fully. Address any questions or concerns with your attorney, loan officer, insurance company, or whomever prepared the document prior to your notary appointment.
  • Bring Photo ID: Bring valid government-issued identification (e.g., driver's license, passport) to verify your identity.
  • Arrange Signers: Ensure all required parties are present to sign in front of the notary. Arrange witnesses if needed.
  • Know Notary Type: Determine the type of notarization required (e.g., acknowledgment, jurat) and inform the notary.
  • Check Requirements: Verify any specific requirements (e.g., witnesses) beforehand to prevent delays.
  • Confirm Appointment: Double-check the appointment details, including date, time, and location. For mobile services, ensure accessibility.

FAQs

What forms of Identification are acceptable?

  • Valid Government-Issued Photo ID: This is the most commonly accepted form of identification. Examples include a driver's license, passport, state ID card, or military ID card.
  • Valid Passport: A passport serves as a reliable form of identification for notary purposes, especially for individuals without a driver's license or state ID.
  • Valid State-Issued ID Card: Some individuals may not have a driver's license but possess a state-issued identification card, which is also acceptable for notary appointments.
  • Valid Military ID: Active duty military personnel and veterans can use their military ID as a valid form of identification for notary appointments.
  • Valid Resident Alien Card (Green Card): For non-U.S. citizens residing legally in the country, a resident alien card serves as acceptable identification for notary purposes.

What forms of Identification are not acceptable?

  • Expired IDs: Any form of identification that has expired is generally not acceptable for notarization purposes.
  • School IDs: Student identification cards issued by educational institutions are typically not considered valid forms of identification for notary purposes.
  • Social Security Cards: While a Social Security card may contain your name and identification number, it lacks a photograph and is therefore not suitable as a standalone form of identification for notarization.
  • Credit or Debit Cards: Payment cards, such as credit or debit cards, do not qualify as valid identification for notarization purposes.
  • Birth Certificates: While birth certificates are official documents, they are not considered acceptable forms of identification for notarization due to their lack of a photograph and standardized security features.
  • Library Cards: Library cards issued by public libraries are not accepted as valid forms of identification for notary purposes.

Can a notary public provide legal advice?

  • No, notary publics are not licensed to provide legal advice. Their role is strictly limited to witnessing the signing of documents and verifying the identity of the signers.

How long does a notarization last?

  • Once a document is notarized, it typically remains valid indefinitely. However, some institutions may have specific requirements regarding the age of notarized documents, so it's best to check with the recipient of the document.

Can a notary public refuse to notarize a document?

  • Yes, a notary public can refuse to notarize a document if they have reason to believe it is fraudulent, incomplete, or if the signer does not meet the requirements for notarization. Additionally, notaries may refuse to notarize if they have a conflict of interest or if it goes against their ethical or legal obligations.

How much does it cost to hire a signing agent in California?

  • The cost of hiring a signing agent in California can vary depending on factors such as the complexity of the transaction, location and the services provided. It's advisable to request a quote or fee schedule from the signing agent beforehand.
